Terms of Service Provided

Your use of the tribalwarrior.org website and all materials received through such use is governed by the terms and conditions of this Agreement. By establishing a connection to tribalwarrior.org, you agree to the following terms for access to and use of tribalwarrior.org.

1. Definitions.

"tribalwarrior.org" is the interactive online information provision service (website) provided by the Tribal Warrior Association Inc. (Tribal Warrior) on the World Wide Web of the Internet, consisting of information, advertising, products, and other content, provided by Tribal Warrior, its affiliates, and other third parties. "User" refers to each person who establishes a connection ("Service Access") to use tribalwarrior.org. "You" or "yours" refers to each person who is a User.

2. General.

This Agreement sets forth the terms and conditions that apply to the use of tribalwarrior.org by Users. By using tribalwarrior.org, you agree to comply with all of the terms and conditions of this Agreement. The right to use tribalwarrior.org is personal to you and is not transferable to any other person or entity.

3. Changed Terms.

Tribal Warrior shall have the right at any time to change or modify these terms and conditions, or to impose new conditions with respect to your use of tribalwarrior.org. Tribal Warrior shall have the right at any time to change or discontinue any aspect or feature of tribalwarrior.org. Tribal Warrior shall not be obliged to give any prior notice of such changes, other than updating these Terms of Service Provided.

4. Copyright.

tribalwarrior.org contains copyrighted material, trademarks, and other proprietary information, including, but not limited to, text, software, photographs, video, graphics, music and sound. The entire contents of tribalwarrior.org are copyrighted as a collective work under Australian and international copyright laws. Tribal Warrior owns a copyright in the selection, co-ordination, arrangement and enhancement of such content, as well as in the content original to it. You may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part. You may download copyrighted material for your personal use only. Except as otherwise expressly permitted under applicable copyright laws, no copying, automated browsing or downloading, redistribution, publication, or commercial exploitation of material available on tribalwarrior.org is permitted without the express permission of Tribal Warrior and the copyright owner in writing. In the event of any permitted use of copyrighted material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made.

The foregoing provisions are for the benefit of Tribal Warrior, its affiliates, and its third-party content providers and licensers, and each shall have the right to assert and enforce such provisions directly on its own behalf.

5. Submissions for Publication.

You shall not submit any editorial material protected by copyright, trademark or other proprietary right to tribalwarrior.org for publication, without the express permission of the owner of the copyright, trademark or other proprietary right. The burden of determining that any material is not protected by copyright rests with you. You shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. By submitting material to tribalwarrior.org, you automatically grant, or warrant that the owner of such material has expressly granted Tribal Warrior the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. You also permit any other User to access, view, store or reproduce the material for that User's personal use. You hereby grant Tribal Warrior the right to edit, copy, publish and distribute any material made available on tribalwarrior.org by you, unless otherwise agreed in writing.

Tribal Warrior shall have the right in its sole discretion to edit, refuse to publish or remove any material submitted to or published on tribalwarrior.org. This right shall not be deemed to have been waived by acceptance and/or prior publication of any such material.

6. Indemnification.

You agree to defend, indemnify, and hold harmless Tribal Warrior, its affiliates, and their respective directors, officers, employees, and agents from and against all claims and expenses, including legal fees, arising out of the use of tribalwarrior.org by you or your Service Access.

7. Miscellaneous.

This Agreement and any Tribal Warrior policies relating to your operation of tribalwarrior.org constitute the entire agreement between Tribal Warrior and you with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. This Agreement shall be construed in accordance with the laws of the Commonwealth of Australia, without regard to its conflict of laws rules. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.
